The new Regulatory Reform (Fire Safety) Order 2005 (RRFSO) came into force on 1st October 2006.

Where does the Fire Regulation apply?

The order applies to all non-domestic premises such as:

• Shops and Offices;
• Premises that provide care, including hospitals and care homes
• Community halls, places of worship and other community premises.
• Shared area of properties that several households live in
• Schools and Sports .entres
• Tents and Marquees
• Hotels and Hostels
• Factories and Warehouses.

The fire safety Legislation does not apply to:

• People's private homes
• Offshore installations
• Ships
• Fields/woods
• Aircraft
• Locomotives, rolling stock
• Mines
• Boreholes

What must I do to comply with the Fire Safety Legislation?

In order to comply with the order you must:

• Carry out a Fire Risk Assessment identifying any possible dangers and risks.
• Consider who may be especially at risk.
• Get rid of or reduce the risk from fire as far as is reasonably possible and provide general fire precautions to deal with any possible risk left.
• Take other measures to make sure there is protection if flammable or explosive materials are used or stored;
• Create a plan to deal with any emergency findings; and review your findings when necessary.
• Who is responsible for meeting the Fire Safety Legislation order.

Under the order, anyone who has control of premises or anyone who has a degree of control over certain areas or systems may be a "responsible person".  Responsible person is defined as:

In relation to a workplace, the employer, if the workplace is to any extent under his contrthe person who has control of the premises (as occupier or otherwise) in connection with the carrying on by him of a trade, business or other undertaking (for profit or not); or the owner, where the person in control of the premises does not have control in connection with the carrying on by that person of a trade, business or other undertaking.
